Terms and Conditions for Southern Gutter Solutions

These Terms and Conditions (“Terms”) govern your use of our website and the gutter services we provide, including free estimates, gutter installation, repair, cleaning, seamless gutters, and gutter guard systems in Daphne, Alabama and throughout Baldwin County. By accessing our website, requesting a quote, scheduling service, or allowing us to perform work on your property, you agree to these Terms. If you do not agree, please do not use our website or request our services.

1. Acceptance of Terms
By using our website or engaging our services, you agree to be bound by these Terms, our Privacy Policy, and any specific service agreement or quote we provide. If you are requesting services on behalf of a homeowner association, property manager, or other entity, you represent that you have full authority to bind that entity to these Terms.

2. Our Services
Southern Gutter Solutions offers professional gutter-related services including, but not limited to:

  • Gutter cleaning and maintenance
  • Gutter repair and restoration
  • Seamless gutter installation and replacement
  • Gutter guard systems (micro-mesh and other premium options)
  • Downspout repair and extension
  • Gutter system inspections

Detailed scope, pricing, and timelines will be provided in your written estimate or service agreement. All work is performed in accordance with local building codes and manufacturer specifications.

3. Estimates and Quotes
All estimates are provided free of charge and are valid for 30 days unless otherwise stated. Estimates are based on information you provide and a visual inspection. Final pricing may be adjusted if additional issues (such as hidden damage, structural problems, or access limitations) are discovered during the job. We will notify you of any price changes before proceeding.

4. Scheduling and Appointments
Once you accept a quote, we will schedule your service at a mutually convenient time. We make every effort to arrive on time, but weather, traffic, or unforeseen delays may occur. We will notify you as soon as possible of any changes.

5. Client Responsibilities
You agree to:

  • Provide accurate property information and access to the work area (clear pathways, safe ladder placement, and removal of obstacles).
  • Ensure pets and children are secured away from the work zone for safety.
  • Disclose any known hazards (bees, electrical lines, roof damage, etc.).
  • Grant us permission to take before-and-after photos of the work for our records and marketing (we will never publish identifiable images without your separate written consent).

Failure to provide safe access may result in rescheduling or additional trip fees.

6. Payment Terms

  • Small jobs (under $500) are due in full upon completion.
  • Larger installations or repairs require a 50% deposit to schedule and the balance due upon satisfactory completion.
  • We accept cash, checks, credit cards, and financing options (where available).
  • Late payments may incur interest at 1.5% per month or the maximum allowed by Alabama law.
  • All payments are non-refundable except as expressly provided in our cancellation policy below.

7. Cancellations and Rescheduling

  • You may cancel or reschedule with at least 24 hours’ notice at no charge.
  • Cancellations with less than 24 hours’ notice or “no-shows” may incur a $150 trip fee.
  • For installation jobs where materials have already been ordered or fabricated, cancellations after deposit may result in forfeiture of the deposit to cover material costs.
  • We reserve the right to cancel or reschedule due to unsafe conditions or severe weather.

8. Warranties and Guarantees

  • All new seamless gutter installations and gutter guard systems carry a manufacturer’s warranty (typically 10–20 years) plus our own workmanship warranty of 5 years.
  • Repairs and cleaning are warranted for 1 year against defects in our work.
  • Warranties do not cover damage caused by acts of God, improper maintenance, or modifications by others.
  • Full warranty details are provided in your service agreement.

9. Intellectual Property
All content, logos, images, and materials on our website are the property of Southern Gutter Solutions or our licensors. You may not reproduce, distribute, or use them for commercial purposes without our written permission.

10. Privacy and Data Protection

11. Limitation of Liability
Our services are provided “as is.” We do not guarantee that your gutters will never clog or overflow under extreme weather conditions. In no event shall Southern Gutter Solutions or its owners, employees, or agents be liable for any indirect, incidental, or consequential damages (including water damage, mold, or loss of property value) arising from our services, except as required by Alabama law. Our total liability shall not exceed the amount you paid for the specific service in question.

12. Indemnification
You agree to indemnify, defend, and hold harmless Southern Gutter Solutions, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your breach of these Terms, your negligence, or any hazardous conditions on your property that were not disclosed to us.

13. Dispute Resolution
Any disputes arising from these Terms or our services will be resolved through binding arbitration in Daphne, Alabama, in accordance with the rules of the American Arbitration Association, or in the courts of Baldwin County, Alabama if arbitration is not available. This agreement shall be governed by the laws of the State of Alabama.

14. Changes to Terms
We may update these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms.

16. Miscellaneous
These Terms constitute the entire agreement between you and Southern Gutter Solutions regarding our services. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
